낙인 이론이 있기 전, 기존의 사회학적 관점들은 일탈(Deviance)을 '동의된 규칙'에 대한 위반 정도로 간주해왔다. 누가 규칙을 깼는지, 그들의 개인적 성격이라든가 삶의 상황속 요소들이 어떻게 일탈에 영향을 미쳤는지에 대한 논의가 중점적이었던 것.
하지만 'Social groups create deviance by making the rules whose infraction constitutes deviance, and by applying those rules to particular people and labelling them as outsiders'라는 말로 기존 논의를 깨뜨림.
일탈은 행위 그 자체에 어떤 가치가 내포되었다기 보다는, 그 행동에 대해 다른사람들이 어떻게 반응하는지에 달려있다는 것.

사회적으로 권력을 가진 사람들에게 유리한 방식으로 규칙이 만들어진다는 걸 강조한다는 점에서, 계보를 보자면 Marx의 갈등론 라인이 아닐런지. 절대적으로 나쁜 행동은 없다는 걸 강조하기에 근본주의자들과는 정반대의 입장이고, 구조주의자들과 같은 맥락. '다양성을 어디까지 인정해야 하는가'에 대한 논의가 활발한 요즘에 각광받을 수 밖에 없을 듯. 아마 가장 잘 맞아떨어지는 건 동성애에 대한 논의가 아닐까.. 뭐 안락사, 줄기세포연구, 대마초 허용에 관한 것도 가능하겠고.
